Once again 5 Essex Court is involved in advising on issues concerning national policing policies. A number of Force Solicitors instructed Fiona Barton QC to advise on the impact of the recent decision of McCombe J in R (Chief Constable of Greater Manchester Police) v Salford Magistrates Court and Paul Hookway . Practical advice was given regarding operational policing pending appeal or legislative change. Advice was also given on the potential liabilities of Forces and officers. The resulting dialogue between Force Solicitors, Chief Officers and the Home Office had led to a high level of co-operation between interested parties, causing the courts and legislature to move with virtually unprecedented speed. The Police( Detention and Bail) Bill will be considered by Parliament on 7th July 2011 and it is hoped that the legislation will be enacted within days. In addition the Supreme Court will hear the appeal (if it still remains necessary after legislative amendment) on 25th July 2011.
