Peter Taheri appeared for the Chief Constable in a recent disability discrimination claim in the Employment Tribunal where the Claimant relied on the principle in Archibald v Fife Council (House of Lords, 2004). The Claimant, who had been an probationer Police Constable, but could not pass her probation by reason of her disability, claimed inter alia that the Chief Constable had failed to make a reasonable adjustment by not slotting her into a civilian staff role without competitive process.

In finding for the Chief Constable, the Tribunal relied on the distinctions in status between probationer Constables and fully-serving officers and civilian staff members. The Tribunal also distinguished re-engagement from offering employment by a new employer (i.e., the Police Authority) for the first time.
