Jonathan Dixey
YEAR OF CALL 2007
Background:
Having read law at University, Jonathan was called to the Bar by Lincoln’s Inn in 2007. Upon completion of pupillage he accepted tenancy at 5 Essex Court in 2008.
He accepts instructions in all of chambers’ main practice areas.
Police Law:
Jonathan acts on behalf of the police in a range of civil matters including applications for:
- Anti-Social Behaviour Orders
- Sexual Offences Prevention Orders
- Risk of Sexual Harm Orders
- Notification Orders
- Foreign Travel Orders
- Football Banning Orders
- Closure Orders (Part 1 and Part 1A of the Anti-social Behaviour Act 2003)
and applications under the Proceeds of Crime Act 2002 and Police Property Act 1897. He also conducts appeals to the Crown Court, including appeals under the Firearms Act 1968.
Having been instructed as in-house Counsel with a police authority, Jonathan has acted in a range of cases including applications for judicial review relating to police duties of disclosure, stop and search, stop and account and the retention of DNA. He has advised on a wide range of matters involving the police, including conduct and performance matters, business interests and conduct policies. He has advised upon and been instructed in police disciplinary matters.
Jonathan has experience of a wide range of matters relating to police forces, including personal injury and employment claims, misfeasance, wrongful arrest and false imprisonment. He has acted in matters concerning the Data Protection Act 1998, the Freedom of Information Act 2000 and the Regulation of Investigatory Powers Act 2000.
Jonathan acted for the Metropolitan Police in the Coroner’s Inquests into the London Bombings of 7 July 2005.
Public/Administrative Law:
Having obtained an LL.M. in Public Law, Jonathan continues to have an interest in public and administrative law. He has acted as an in-house advisor to the Treasury Solicitor’s Prisons team, which entailed advising upon claims for negligence, false imprisonment and breaches of the Human Rights Act 1998.
Jonathan has been instructed in a range of public law matters involving the Home Office (including R (Limbu and others) v. Secretary of State for the Home Department; Entry Clearance Officer, Kathmandu; Entry Clearance Officer, Hong Kong [2008] EWHC 2261 (Admin)), the Ministry of Defence and the Ministry of Justice. He has also drafted Grounds of Resistance in applications for judicial review arising out of the refusal to grant leave to remain in the UK.
Employment Law:
Jonathan has experience of a range of employment matters including unfair dismissal, breach of contract, discrimination, redundancy, TUPE, compromise agreements, restrictive covenants and injunctions. He acts on behalf of both claimants and respondents. Before joining the Bar Jonathan advised at the Citizens’ Advice Bureau offering a particular focus on employment disputes.
He is a member of ELBA.

Smith v. The Governing Body of Hillbrook Primary School – Successfully defended the respondent in a claim for unfair and wrongful dismissal.
Kenny v. TFL Truck Fitments Ltd. – Unfair dismissal, wrongful dismissal, unlawful deduction of wages and failure to comply with the new ACAS Code of Practice on Disciplinary and Grievance Procedures.
Mengesha v. London Borough of Tower Hamlets – Age and race discrimination.
Smith v. Sainsbury’s Supermarkets Ltd. – Unlawful deduction of wages.
Goodban v. East Kent Road Car Ltd. – Costs awards in the Employment Tribunal.
Lewis v. London Borough of Tower Hamlets – Disability discrimination, unfair dismissal and unlawful deduction of wages.
Bazouzi v. West Engineering Ltd. – Race discrimination (including allegations of victimization and harassment).
Licensing Law:
Jonathan is instructed by a number of police forces and local authorities in hearings and appeals pursuant to the Licensing Act 2003. He also advises in matters related to licensing.
Jonathan is regularly instructed in Private Hire Vehicle, Hackney Carriage and Private Hire Vehicle Operator’s licences appeals. He also appears in appeals to the Crown Court.
Personal Injury:
Jonathan has extensive experience advising upon a broad range of personal injury matters including employers’ and occupiers’ liability, slipping and tripping, manual handling and RTA claims. He regularly appears in the county court on such matters acting for both claimants and defendants. He also has experience of, and a particular interest in, credit hire issues arising out of road traffic litigation.
He is a member of PIBA.

M v. Foreign and Commonwealth Office – Claim for PTSD arising out of an accident in Iraq.
Commercial Law:
Jonathan is regularly instructed on a range of commercial matters and has experience of conducting trials on the small, fast and multi tracks.
Lectures:
Jonathan is part of 5 Essex Court’s NPIA-approved training team for the Police (Conduct) Regulations 2008 and Police (Performance) Regulations 2008.
He is happy to provide CPD lectures on all aspects of his practice.
